Terms of Service

These Terms of Service ("Terms") govern your use of the All-N-Time mobile application (the "App") operated by Blue-Berg Solutions ("we", "us", "our"). By accessing or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
2. Account Responsibilities
When you create an account with us, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with others.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
3. Acceptable Use
You agree not to use the App to:
- Violate any applicable local, state, national, or international law or regulation.
- Submit false, misleading, or fraudulent time records, location data, or photos.
- Attempt to gain unauthorized access to any portion of the App or its related systems.
- Interfere with or disrupt the integrity or performance of the App.
- Use the App for any purpose other than its intended business use of workforce and job site management.
4. Intellectual Property
The App, including its design, code, features, content, and branding, is the property of Blue-Berg Solutions and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
5. User Content
You retain ownership of any content you submit through the App, including photos and work records. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content as necessary to provide and improve our services. Your organization's administrators may access and manage content submitted within their organization.
6. Service Availability
We strive to keep the App available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable for any downtime or service interruptions.
7. Limitation of Liability
To the fullest extent permitted by law, Blue-Berg Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, secure, or available at all times.
9. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time by contacting us. Provisions that by their nature should survive termination will remain in effect, including intellectual property rights, limitation of liability, and dispute resolution.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Davis County, Utah.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
